A committal proceedings has been initiated against Chairman of the Independent National Electoral Commission (INEC) and the leadership of the People’s Democratic Party for their disobedience to the court Judgment delivered by Hon. Justice J.O Abdulmalik of the Federal High Court, Abeokuta on the 26th September, 2022.
Prior to the Judgment, Hon. Olanrewaju Solomon Enilolobo had taken part in the primary of the People’s Democratic Party into the Abeokuta South State Constituency 1, and became victorious among other contenders. The primaries which took place on the 30th April, 2022 at the Centenary Hall, Ake Abeokuta was conducted by the leadership of their party, and was monitored by the Independent National Electoral Commission (INEC), DSS, Nigerian Police Force and other security agents.
To his utmost surprise, Hon. Olanrewaju Solomon Enilolobo noticed that his name was not forwarded to the Independent National Electoral Commission (INEC) in line with the provisions of the Electoral Act 2022, rather it was the name of one Messrs Lukman Atobatele who just cross carpeted from the Allied People’s Movement (APM) with no background in People’s Democratic Party that was sent to the INEC.
This infractions gave rise to the suit he filed against the PDP, Dr. Iyiorchia Ayu, Mr Sunday Sodipe, INEC and others in suit number FHC/AB/CS/80/22. At the end of the case, Hon. Enilolobo again defeated all the defendants and they were all mandated to comply with the dictates of the Electoral Act by making him (Hon. Olanrewaju Solomon Enilolobo) the candidate of the People’s Democratic Party (PDP) to represent the good people of the Abeokuta South State Constituency 1 in the 2023 general elections.
The Judgment, which remained unappealed as at the time of compiling this reports, and the three months window to Appeal being closed, Hon. Olanrewaju Solomon Enilolobo has approached the Federal High Court sitting in Abeokuta to commit the INEC Chairman, Prof. Mahmoud Yakubu, PDP Chairman Dr. Iyorchia Ayu, Sunday Sodipe and others to prison for their failure to comply with the Judgement of 26th September, 2022.
According to court processes made available to our correspondents, and baring any last minutes change, the respondents might have their days in prison if the committal orders are granted by the court.
