The Federal High Court warns to strike out a land dispute lawsuit against Sen. Iyabo Obasanjo and others due to lack of prosecution. Case adjourned to March 15
The Federal High Court in Abuja has issued a warning to strike out a lawsuit filed against **Sen. Iyabo Obasanjo** and several others over a land dispute in the Asokoro District of the **Federal Capital Territory (FCT)** due to a lack of diligent prosecution.

The warning was issued by **Justice Inyang Ekwo** on Thursday after the plaintiffs—**ABB Electrical Systems Limited** and **Amb. Yohana Margif**, along with their legal representative—failed to appear in court.

The plaintiffs had filed a suit against **Senator Iyabo Obasanjo**, **former FCT Senator Philip Aduda**, and five other defendants, alleging an unlawful attempt to take possession of **Plot 4254, Cadastral Zone A04**, a 1.67-hectare plot of land. The land in question is located in the highly sought-after **Asokoro District**.
At the hearing, only the counsel for the **4th defendant**, **John Mbata**, appeared, though he informed the court that he had not been officially served with the court documents. He had, however, come to know about the case through online sources.
In response, Justice Ekwo granted the plaintiffs a **final opportunity** to appear in court and pursue their case, warning that failure to do so during the next hearing on **March 15, 2025**, would result in the lawsuit being struck out.
Earlier, the plaintiffs had sought an **interim injunction** to prevent the defendants from tampering with or trespassing on the disputed land, citing imminent threats to their ownership.
However, the court rejected the ex-parte motion, insisting that the defendants must be heard before any such order could be made.
In an affidavit, **Amb. Yohana Margif** stated that the land had been legally allocated to **ABB Electrical Systems Limited** in **2006**, and recent activities by the defendants were seen as a threat to the company’s legal ownership.
The case has been adjourned to **March 15, 2025**, for further mention. The plaintiffs will have to demonstrate a diligent prosecution at that time to avoid the court striking out the matter.
