A Federal High Court in Abuja on Tuesday struck out a legal action filed by former lawmaker representing kogi West, Senator Dino Melaye; challenging the Infectious Disease Control Bill (2020) sponsored by the speaker of the House of Representatives, Femi Gbajabiamila.
The court struck out the suit on the ground that it is not justifiable .
Delivering ruling in the preliminary objection raised against the court action, Justice ljeoma Ojukwu held that Melaye’s complaints were based on a proposal that has not become bill.
The judge held that until the bill is passed and assented to by the President it has no force of law and as such can not stand the test of law.
Justice Ojukwu also noted that the plaintiff failed to establish any breach of his rights as averred in the suit.
